TERMS AND CONDITIONS

The terms and conditions represent the basis upon which training is offered by Chris Baines Driver Training (CBDT). By undertaking driving lessons you are accepting these terms and conditions. CBDT follows the DVSA  ADI Code of Practice. CBDT is a high quality, no-frills driving school operating in a relaxed, easy going environment with a friendly professional approach offering the latest instructional methods and safe driving protocols. If you have any concerns please don’t hesitate to ask or contact me via e-mail or text, and I’ll reply as soon as possible. Please be assured that all concerns are always taken with the utmost diligence and discretion assuring you of our best intentions. Students are requested to book at least one 2 hour lesson per week to retain their place on the training schedule. Rates may be subject to change and CBDT reserves the right to alter these without written prior notice.

Cancellation

In line with most driving schools the CBDT reserve the right to charge pupils for failing to provide adequate notice for cancelling lessons of instruction. As is common practice within the industry CBDT will need a minimum of 24 hours’ notice if you are unable to attend your driving lesson otherwise you may be charged for any loss of revenue. CBDT may request evidence to support your reason for cancellation. All lessons unless by written prior arrangement must be paid for (minimum 24 hours) in advance to guarantee tuition. Student arrival more than 15 mins late for any lesson may result in cancellation and may still be charged for loss of revenue to avoid further disruption to scheduled appointments. Cancelled lessons due to instructor illness will be rescheduled as soon as possible at no extra cost. Exceptional circumstances such as family emergencies, bereavement, etc., will be taken into consideration (evidence to support the reason for cancellation may be required) and any rescheduled driving lesson will be at no extra cost. Students voluntarily withdraw from training after making a confirmed booking will be subject to a withdrawal fee of 2 hours lesson costs.

Health & Safety

The health and safety of student and instructor is of paramount importance. The CBDT will follow the health and safety procedures in accordance with current Public Health England, DVSA and Government guidelines. A risk assessment will be carried out prior to each training session and available to view if required.

Personal conduct

The instructor will always behave in a professional manner towards the student and act in accordance with current legislation on equality, diversity, and discrimination. Students will be treated with respect and consideration. The instructor will avoid physical contact with students except to mitigate an immediate risk, in an emergency or in the normal course of a greeting. CBDT operates a zero tolerance policy with regard to threat, abuse and inappropriate behaviour towards CBDT staff.

Terms of business

CBDT will safeguard and account for any advance payment by the student in respect of driving lessons, test fees or for any other purpose and will make the details available to the client on request. CBDT will follow current GDPR rules. CBDT on or before the first lesson should provide students with details and/or a copy of the terms and conditions of Chris Baines Driver Training, including the legal identity, address and contact number at which the instructor can be contacted, the cost and duration of lessons, charges and conditions for use of a CBDT driving school car for the practical driving test, the terms under which cancellation by either party may take place. CBDT will advise students when to apply for their theory and practical driving tests, taking account of DVSA’s cancellation rules, local waiting times and forecast student’s potential for achieving the driving test pass standard. The instructor will not cancel or re-arrange a driving test without the student’s agreement. In the event of the instructor’s decision to withhold the use of the school car for the driving test, sufficient notice should be given to the student to avoid loss of the DSA test fee. The instructor should always, to the best of his or her ability, endeavour to teach the student correct driving skills according to DSA’s recommended syllabus. CBDT reserve the right to withdraw tuition at any time without prior notice or written consent.

Lessons, traffic & communication

CBDT has no control over road conditions and whilst having extensive knowledge of the local area CBDT cannot be held responsible for any delays that this may cause in over-run lesson time (you will not be charged for the over-run lessons) and/or lateness to appointments such as but not limited to your practical driving test. A method of contact will be agreed prior to the commencement of any training and you must inform the instructor if there are any changes to the agreed initial method of contact, CBDT cannot be held responsible for non-attendance of training due to such changes.

Tuition Vehicle and Practical Driving Test

By prior mutual agreement both, the CBDT will ensure the vehicle and instructor is available for your confirmed driving test. If you fail to consult with your driving instructor, availability may not be guaranteed. It is the student’s responsibility to take the required documentation to their practical driving test your driving instructor will not be held responsible if your test is cancelled due to missing documentation. While every effort is made to maintain the instructional vehicle to a high standard, if the test cannot proceed due to mechanical failure, CBDT will provide the vehicle and instructor to the trainee for their next driving test at no extra cost. We will not be responsible for other incidental out of pocket expenses i.e., time off work, travel expenses, etc.

Infringements, Fit and Legal

The instructor will check a student’s entitlement to drive the vehicle and his or her ability to read a number plate at the statutory distance on the first lesson. CBDT must be informed if there are any changes/impending changes to a student’s licence or ability to drive due to contravention of any laws or regulations. CBDT cannot be held responsible for any speeding fines, contraventions of traffic law etc., and any infringements will be the sole responsibility of the student whilst they are in control of the vehicle. A student deemed unfit to drive due to but not limited to; being under the influence of alcohol or drugs, not wearing prescription glasses, showing signs/symptoms of a cold/flu/virus after declining the request to wear a face covering, etc., the driving instructor will refuse tuition and you may be charged for any loss of revenue.

Marketing & Advertising

The advertising of driving tuition shall be a true reflection of the business, claims made shall be capable of verification and comply with current CAP advertising codes.

Advertising that refers to student pass rates should not be open to misinterpretation and the basis on which the calculation is made should be made clear.

Conciliation

Complaints by the student should be made in the first instance to the driving instructor following the complaints procedure issued. If having completed the procedure, the client has been unable to reach an agreement or settle a dispute, further guidance may be sought; if a client believes that their instructor is not providing a satisfactory business service they can contact their local Citizens Advice Bureau for guidance.
